The lemon laws exist to protect automobile owners, including you, from serious defects in the cars you buy. As you leave the parking lot, you have your vehicle guide and new car warranty papers. Of course, he is a little more polite, so you drive home. Almost. Once you try to go over 40 mph, the same thing happens. You take it back, since it's still under a car warranty. Just to humor you, they add some drying agent to the gas tank and tell you to use a better grade of fuel.

Trying to get home, you still can only go 40 mph. You take it back again. After the third try, not only will it not accelerate, but there is smoke coming from the driver's seat! Two options spring to mind. Since the first one will cost you 30 years to life, you opt to research your state's lemon laws.

In most states, you will find a Lemon Law pamphlet explaining your rights among the papers when you bought your new car. You may have to look hard. I guarantee the salesman is not going to hand it to you.

Every state has their own little variations. The California lemon law is the most pro-active. They put the LAW in the LEMON and squirt it in the dealer's eye! The common form of the Lemon Law, however, tries to strike a balance. Most expect the new car warranty to take care of the problem. The Texas lemon law allows the dealer up to three tries to repair the car. If the problem persists, he must either trade for another car, or, in some cases, return your money less any mileage you actually got to use.

The best advice is to take a long test drive FIRST. If it is a used car, take it to a good mechanic at another shop. If you have to call upon the lemon law, be sure you have documented every call, every visit, and every person you have talked to, and when. The best lemon law defense is solid fact. And that's a fact!
